Listing Nav is operated by InFlux LLC.
1. Effective Date

This Terms of Service agreement ("Agreement") is a legally binding contract between you ("you" or "User") and InFlux LLC, doing business as Listing Nav ("we," "us," or "the Platform"), governing your use of the Listing Nav platform located at listingnav.com and all related services.
2. Acceptance of Terms
By accessing or using Listing Nav, creating an account, or clicking "I agree," you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy.
You must be at least 18 years of age to use this Platform. By using Listing Nav, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.
If you do not agree with any part of this Agreement, you must not use the Platform.
3. Description of Service
Listing Nav is a technology platform that provides branded websites and marketing tools for real estate professionals. The Platform enables real estate agents and brokerages to create their own branded websites, manage property listings, capture and manage leads, and gain exposure through our aggregated marketplace.
The Platform serves three types of users:
- Seekers — Free users who browse property listings across the marketplace and submit inquiries.
- Agents — Real estate professionals who subscribe to create and manage their own branded property website.
- Brokerages — Real estate brokerages that subscribe to manage multiple agent sites under their brand.
Listing Nav is NOT a licensed real estate broker, agent, or Multiple Listing Service (MLS). We do not participate in real estate transactions, provide real estate advice, or guarantee the accuracy of any listing information. All property listings are provided by third-party tenants (agents and brokerages) who use our platform.
4. Account Registration
To access certain features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate.
- Maintain the security and confidentiality of your password and not share your login credentials with any third party.
- Accept responsibility for all activities that occur under your account.
- Use only one account per email address.
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or incomplete, or if we determine that your use of the Platform violates this Agreement.
5. Subscription Plans & Auto-Renewal
Listing Nav offers the following subscription plans:
Seeker (Free)
Free forever. Browse property listings across the marketplace and submit inquiries to agents and brokerages.
Agent Plan — $80/month
30-day free trial, then $80 per month. Includes up to 50 active property listings, up to 50 photos per property, lead management tools, marketplace exposure, and a team of up to 5 members (1 owner + 4 team members). Additional team members may be added at $10 per month each.
Brokerage Plan — $400/month
30-day free trial, then $400 per month. Includes 5 agent sites, a management team of up to 10 members, and up to 50 total agents. Additional agents beyond the 5 included may be added at $50 per month each. Additional team members on child agent sites may be added at $5 per month each.
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE THEN-CURRENT RATE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
How to cancel: You may cancel your subscription at any time through your account settings page or by contacting us at support@listingnav.com. Cancellation will take effect at the end of your current billing period.
No partial refunds: We do not provide refunds or credits for any partial subscription periods. If you cancel, you will retain access to paid features until the end of your current billing cycle.
Payment processing: All payments are processed securely through Stripe. Listing Nav does not directly store your credit card information.
Price changes: We will provide at least 30 days' advance notice before any changes to subscription pricing. Continued use of the Platform after the effective date of a price change constitutes acceptance of the new pricing.
6. Free Trial Terms
Agent and Brokerage plans include a 30-day free trial with full access to all plan features. At the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable monthly rate unless you cancel before the trial ends.
Free trials are limited to one per person or business entity. If we determine that you have previously used a free trial (whether under the same or a different account), we reserve the right to terminate the duplicate trial and begin billing immediately.
7. Tenant Responsibilities
If you are an agent or brokerage ("Tenant") using Listing Nav to create and manage a website, you are solely responsible for:
- The accuracy, completeness, and legality of all content you publish, including property listings, descriptions, pricing, images, and any other information displayed on your tenant site.
- Ensuring you have proper authorization to list all properties displayed on your site.
- Compliance with the Fair Housing Act and all applicable federal, state, and local fair housing laws. You may not publish any listing or content that discriminates based on race, color, religion, sex, national origin, familial status, disability, or any other protected class.
- Complying with all applicable real estate licensing laws and regulations in the jurisdictions where you operate.
- Handling lead data in compliance with all applicable privacy and data protection laws, including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any applicable state privacy laws.
8. User-Generated Content & Intellectual Property
Your content: You retain ownership of all content you upload, create, or publish on the Platform, including but not limited to property descriptions, photographs, business information, and branding materials. By publishing content on Listing Nav, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce your content solely for the purpose of operating and promoting the Platform and your tenant site.
Our technology: Listing Nav, including its software, design, templates, layout structures, and all underlying technology, is the intellectual property of InFlux LLC. You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform's technology or template system.
DMCA procedure: If you believe that content on the Platform infringes your copyright, please send a written notice to support@listingnav.com that includes: (a) identification of the copyrighted work, (b) identification of the infringing material and its location on the Platform, (c) your contact information, (d) a statement of good faith belief, and (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf. We will respond to valid DMCA notices in accordance with applicable law.
9. Lead Data
When visitors submit inquiries or contact forms on the Platform, they consent to their information (including name, email, phone number, and message content) being shared with the relevant tenant (agent or brokerage) to respond to their inquiry.
Tenants are the data controllers for the lead data they receive through the Platform. Tenants are solely responsible for their use of lead data, including compliance with all applicable privacy laws, obtaining any additional consents required, and honoring opt-out requests from leads. Listing Nav acts as a data processor for lead data, processing it on behalf of the tenant.
10. Acceptable Use
You agree not to use Listing Nav to:
- Engage in any illegal activity or violate any applicable law or regulation.
- Send unsolicited messages, spam, or bulk communications to other users or leads.
- Scrape, crawl, or use automated tools to extract data from the Platform without our prior written consent.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload or transmit content that infringes on the intellectual property rights of others.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Platform, its servers, or connected networks.
- Use the Platform in any manner that could damage, disable, overburden, or impair its functionality.
We reserve the right to investigate and take appropriate action against any violations, including suspension or termination of your account.
11. Real Estate Disclaimers
Listing Nav is a technology platform and is not a licensed real estate broker, agent, appraiser, or Multiple Listing Service (MLS). We do not participate in, facilitate, or guarantee any real estate transaction.
- All property listings are provided by third-party tenants (agents and brokerages) and are their sole responsibility.
- We make no representation or warranty as to the accuracy, completeness, or reliability of any listing information, including but not limited to pricing, availability, property condition, or square footage.
- Users should independently verify all property information before making any real estate decisions.
- Listing Nav does not provide real estate advice, legal advice, or financial advice.

12. Indemnification
You agree to indemnify, defend, and hold harmless InFlux LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform or any violation of this Agreement.
- Any content you publish, upload, or otherwise make available through the Platform.
- Your real estate business activities conducted through or in connection with the Platform.
- Any violation of applicable laws, regulations, or third-party rights.
13. Limitation of Liability
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Platform will be available at all times, uninterrupted, secure, or error-free. We are not responsible for any downtime, data loss, or service interruptions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, InFlux LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have violated this Agreement or for any other reason at our sole discretion.
You may cancel your account at any time through your account settings or by contacting us at support@listingnav.com. Upon cancellation or termination, you will have a reasonable period (not less than 30 days) to export your data, after which we may delete your content and account information.
Sections that by their nature should survive termination will survive, including but not limited to Sections 8 (Intellectual Property), 12 (Indemnification), 13 (Limitation of Liability), and 16 (Dispute Resolution).
15. Third-Party Services
The Platform integrates with and relies on third-party services to provide its functionality. These include, but are not limited to:
- Stripe — Payment processing and subscription billing. Your use of Stripe is subject to Stripe's Terms of Service.
- Vercel — Platform hosting and content delivery. Your data may be processed and stored on Vercel's infrastructure.
- Twilio — Communication services for notifications and alerts.
We are not responsible for the practices, policies, or availability of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
16. Dispute Resolution
Governing law: This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles.
Binding arbitration: Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in Oklahoma City, Oklahoma, and shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small claims exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Class action waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Injunctive relief: Either party may seek injunctive or other equitable relief in the state or federal courts located in Oklahoma City, Oklahoma, to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
17. Modifications
We reserve the right to modify this Agreement at any time. For material changes, we will provide at least 30 days' advance notice by posting the updated terms on the Platform and, where practicable, notifying you by email.
Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the updated Agreement. For material changes, we may require you to affirmatively re-accept the updated terms before continuing to use the Platform.
We encourage you to review this Agreement periodically. The "Last updated" date at the top of this page indicates when the most recent changes were made.
